What the CJEU AG’s Opinion in the infringement case against Hungary means for LGBTI equality in the EU

The CJEU Advocate General has just delivered her Opinion in the Commission v Hungary “EU values” infringement case (C-769/22) – a major CJEU case on Hungary’s discriminatory 2021 anti-LGBTI law.

Join us for our session on Thursday, 12 June at 12:30 CEST to discuss the CJEU Advocate General’s Opinion to be rendered on 5 June in the Commission v Hungary “EU values” case (C-769/22). This Opinion will be a crucial step in this infringement case initiated by the European Commission over anti-LGBTI legislation Act LXXIX introduced by Hungary in 2021, which censors inclusive sex education, equates LGBTI ‘lifestyles’ with paedophilia, blocks adoption for LGBTI couples, and restricts content in media and advertising. This infringement constitutes, in the Commission’s view, a violation of Article 2 of the Treaty on European Union, which enshrines the fundamental values of the EU, several articles of the EU Charter of Fundamental Rights and EU directives on services and the audiovisual sector. The Commission was joined in this case by 16 Member States and the European Parliament.
Our speakers will share their views on the Advocate General’s Opinion and tell us what this means for future legal actions urgently needed by the European Commission against Hungary in the aftermath of Hungary’s ban on Pride events and draft anti-CSOs law, but also potential future actions against other EU countries as anti-LGBTI and anti-CSOs bills are spreading in the region.
