Ten years of the “new” Court

Ten years after the setting up of a full-time European Court of Human Rights guaranteeing a right of individual petition to over 800 million Europeans, the President of the Court Jean-Paul Costa hailed the establishment of the “new” Court in 1998 as a landmark in the development of international human rights protection.

Recent Grand Chamber judgments

27/11/2008

In the case of Salduz v. Turkey, the Court held that there had been a violation of Article 6 (right to a fair trial). The applicant complained that he had been denied legal assistance while in police custody and that he had not had access to the written opinion of the Principal Public Prosecutor at the Court of Cassation. 12/11/2008

In the case of Demir and Baykara v. Turkey, the Court held that there had been a violation of Article 11 (freedom of assembly and association). The case concerned the failure by the Court of Cassation in 1995 to recognise the applicants’ right, as municipal civil servants, to form trade unions, and the annulment of a collective agreement between their union and the employing authority.

Autumn session of the Académie des Marches de l'Est, Strasbourg

In the case of K.U. v. Finland, the Court held that there had been a violation of Article 8 concerning the Finnish authorities’ failure to protect a child’s right to respect for private life following an advertisement of a sexual nature being posted about him on an Internet dating site. In the case of Juppala v. Finland, the Court held that there had been a violation of Article 10 (freedom of expression) concerning Ms Juppala’s conviction for defamation of her son-in-law after she had taken her three-year-old grandson to a doctor and voiced a suspicion that he might have been hit by his father. Inadmissibility decision

The Court has declared inadmissible the application lodged in the case of Mann Singh v. France. The case concerns the refusal to permit a practising Sikh to wear a turban in the identity photographs to be used on his licence. Press Release
