Associazione Radicale Certi Diritti has published a short, practical guide that explains how to obtain a “residence card for family members of EU citizens” on behalf of the non-Italian partner of a same-sex couple who has entered into a civil partnership or marriage with an Italian citizen abroad. Certi Diritti is making the guide available to anyone who is interested.

Certi Diritti Secretary Yuri Guiana points out: "Our aim is to make the results that we are obtaining thanks to the Affermazione Civile 2.0 campaign available to all of the associations that deal with rights and to all of the couples who find themselves in a situation similar to those we have dealt with as part of the Affermazione Civile 2.0 campaign. The practice is now well-established and it is therefore possible to identify a standard procedure that we are happy to make available to everyone.”


After Reggio Emilia, Milano, Rimini, and Roma, now also the police in Treviso are releasing an Italian residence permit to a male Mexican citizen who was married in Mexico City to an Italian of the same-sex. Until now, the couple has not been able to live together without interruption and they have incurred signifcant expense traveling back and forth between Italy and Mexico. Now, however, the recognition of their union, even though only for purposes of the residence permit, will allow them “to live freely as a couple,” as the Constitutional Court declared is a fundamental right in its judgment 138/10.


The Affermazione Civile 2.0 campaign will continue with new test cases as they emerge, with the ultimate goal being to obtain marriage equality. Unfortunately, however, the government remains silent on the subject of the Amato Circular, which prohibits the registration in Italy of marriages between persons of the same-sex contracted abroad.
