Hate crime legislation

The Dutch Penal Code does have legal provisions that can be used in court to aggrevate sentences if violence is combined with discrimination (hate crimes). However, police and justice have only rarely used these provisions in hate crime cases, because the violence was easier to prove, and there would be a conviction anyhow. Also, many police and court personnel feel uncomfortable if sexual orientation is involved -- they have the idea that the aggrevating factor can only be proven if the victim is "outed" before court.
